Builders’ Liens are available to unpaid construction contractors and other individuals through a scheme under the Alberta Builders’ Lien Act. The Act is lengthy and you may require legal advice to ensure that as a consequence of your Lien you are compensated for the work you have done.
If you are a contractor and are not getting paid then you have 45 days to file your Builder's Lien at the Land Titles office after your last work or materials were provided. Liens lapse after 180 days if legal action is not filed. In some complicated cases litigation begins to prove the debt and obtain what is owed to you. You may also be able to claim costs of pursuing the outstanding amounts.
